§ 1 General Provisions
For the business relationship between Shape Events, owner Claudia Peters (hereinafter referred to as the "Organizer") and participants of day tours (hereinafter referred to as the "Customer"), only these General Terms and Conditions (GTC) in their valid version at the time of contract conclusion apply. Deviating conditions of the Customer are not recognized unless the Organizer explicitly agrees to their validity in writing.
§ 2 Participation Requirements
(1) The Organizer is entitled to make participation in a tour dependent on the fulfillment of special conditions (such as specific riding skills). Customers must be at least 18 years old.
(2) As a prerequisite for participation, unless otherwise specified, an technically sound bicycle and sufficient puncture repair equipment (e.g., spare tube, puncture kit, pump, tools, etc.) are required. It is not the Organizer's task or obligation to provide technical support in case of a breakdown. If a tour cannot be completed due to a breakdown, any necessary return transport must be carried out at the Customer's own risk and expense.
§ 3 Contract Conclusion
The Customer offers a binding contract by submitting a written or oral registration. The registration also includes all additional participants named by the Customer. The Customer recognizes these Terms and Conditions—also on behalf of and on behalf of the additional participants—as binding.
The contract is concluded when the Organizer confirms the registration via email, fax, or verbally.
§ 4 Prices
The agreed price is specified in the written confirmation of registration.
§ 5 Payment
Payment is made according to the agreement (either in advance via bank transfer or in cash at the end of the event, if possible, exact change).
§ 6 Implementation
(1) The minimum number of participants is specified according to the tour selection. The organizer reserves the right to cancel a tour if the minimum number is not reached.
(2) The maximum group size is 14 persons. Larger groups are arranged upon consultation.
(3) If registered customers do not appear at the agreed time and place, there is no guarantee of participation.
§ 7 Services and Changes to Services
(1) The scope of contractual services results from the description of services or the confirmation by the Organizer.
(2) Special requests or side agreements are only part of the contract if they are confirmed by the Organizer in writing and unconditionally.
(3) The specified sights and locations are the most and primarily visited destinations. The Organizer may deviate to nearby locations without deduction, with the Customer's consent. Organizational reasons may cause deviations from the described schedule, but these do not affect the nature and content of the tour and do not entitle the Customer to withhold payment or partial refunds.
(4) If the Organizer is responsible for the loss of a service, they may replace it with an equivalent service. The Organizer is obliged to inform the Customer and offer free rebooking or a free cancellation.
§ 8 Right of Withdrawal & Termination
(1) The Organizer may terminate the contract without notice if the Customer persistently disturbs the tour despite warnings.
(2) If the Organizer terminates the contract under § 8(1), the Customer has no claim for a refund of the participation fee.
(3) The Customer has the right to withdraw from the contract within two weeks after conclusion without giving reasons. The withdrawal must be made in writing to the Organizer's address. Timely dispatch of the withdrawal is sufficient. If valid, the Organizer will refund any already paid amount.
(4) A registered Customer can withdraw from the tour at any time. The relevant factor is the receipt of the written cancellation by the Organizer. In this case, the Organizer is entitled to claim the following compensation:
Up to 4 days before the tour: no cancellation costs,
3 days before the tour: 100% of the price.
§ 9 Liability and Limitation of Liability
(1) The Organizer is liable within the scope of due diligence for the careful preparation of the events.
(2) Participation in the events is at the participant’s own risk. The Organizer is not liable for damages, accidents, or similar incidents. Each participant must sign a liability waiver on-site.
(3) Compliance with the traffic regulations is the responsibility of the customer.
(4) The information regarding physical requirements and the duration of the tours is provided to the best of our knowledge but without guarantee, as such information is subject not only to subjective assessments but can also be significantly influenced by external factors such as weather conditions. The customer is responsible for ensuring that they are physically capable of participating in the event.
(5) If an event cannot be conducted due to reasons beyond the Organizer’s control (power outage, traffic accident, strike, natural disasters, etc.), the Organizer reserves the right to withdraw from the contract before or during the event. In the latter case, the customer will pay the proportionate event price.
(6) The Organizer is not liable for services that are mediated as third-party services of other providers and are explicitly marked as such. The Organizer is also not liable in case of theft.
§ 10 Invalidity of Individual ProvisionsThe invalidity of individual provisions of the contract does not affect the validity of the entire contract.
