§ 1 General

The following General Terms and Conditions, in the version valid at the time of contract conclusion, apply exclusively to the business relationship between Shape Events, owner Claudia Peters (hereinafter referred to as the organizer), and participants of day tours (hereinafter referred to as the customer). Deviating terms and conditions of the participant will not be recognized unless the organizer expressly agrees to their validity in writing.

§ 2 Conditions of participation

(1) The organizer reserves the right to make participation in a tour dependent on the fulfillment of special conditions (such as the presence of certain technical driving skills). Customers must be at least 18 years old.

(2) Unless otherwise stated, participation in a tour requires a technically sound bicycle and sufficient breakdown equipment (including a spare tube, repair kit, air pump, tools, etc.). It is not the organizer's responsibility or obligation to provide technical support to the customer in the event of a breakdown. If a tour cannot be completed due to a breakdown, any necessary return transport is at the customer's own risk and expense.

§ 3 Conclusion of contract

By registering in writing or verbally, the customer makes a binding offer to conclude the contract. The customer's registration also applies to all additionally named participants. The customer accepts these General Terms and Conditions as binding, also on behalf of and on behalf of the additionally named participants.

The contract is concluded when the registration is confirmed by the organizer by email, fax or verbally.

§ 4 Prices

The customer will see the agreed price in the written confirmation of registration.

§ 5 Payment

Payment is made as agreed (in advance by bank transfer or in cash at the end of the event, if possible in exact amount).

§ 6 Implementation

(1) The minimum number of participants is determined according to the tour selection. The organizer reserves the right to cancel a tour if the minimum number of participants is not reached.

(2) The maximum group size is 14 people. Larger groups can be accommodated by arrangement.

(3) If registered customers do not appear at the agreed start time and place, there is no guarantee of participation.

§ 7 Services and changes to services

(1) The scope of the contractual services is determined from the service description or the confirmation of the organizer.

(2) Special requests on your part or ancillary agreements shall only be part of the contract if they have been confirmed by the organizer in writing and without reservation.

(3) The listed sights and locations are the most frequently and primarily visited destinations. The tour operator must assume your consent to detours to locations in the immediate vicinity in individual cases without deduction. Any deviations from the described itinerary for organizational reasons are possible, but do not affect the nature and content of the tour and do not entitle the customer to retain the contract amount or to a partial deduction.

(4) If the cancellation of a service is due to the organizer's fault, the organizer may replace this service with an equivalent service. The organizer is obligated to inform the customer of this. The organizer will offer the customer a free rebooking or cancellation.

§ 8 Right of withdrawal & termination (1) The organizer may terminate the contract with the customer without notice if the customer persistently disrupts the tour despite a warning from the organizer.

(2) If the organizer terminates the contract with the participant in accordance with Section 8 (1) of the contract terms and conditions, the participant shall not be entitled to a refund of the participation fee.

(3) The customer is entitled to revoke his or her declaration of intent to conclude the contract without stating reasons within two weeks of the conclusion of the contract. The revocation must be made by written revocation to the organizer's address. Timely dispatch of the revocation is sufficient to meet the deadline. In the event of an effective revocation, the organizer will refund any price already paid to the customer.

(4) A registered customer may withdraw from the tour at any time. The date of receipt of the written cancellation by the organizer is decisive. In this case, the organizer is entitled to demand the following compensation: - up to 4 days before the tour: no cancellation fee; - 3 days before the tour: 100% of the price.

§ 9 Liability and limitation of liability (1) The organizer is liable within the scope of the duty of care for the conscientious preparation of the events.

(2) Participation in the events is at your own risk. The organizer assumes no liability for damages, accidents, or the like. Each participant must sign a liability waiver on site.

(3) Compliance with road traffic regulations is the customer’s responsibility.

(4) Information regarding physical requirements and the duration of the tours is provided to the best of our knowledge, but without guarantee, as such information is not only subject to subjective assessments but can also be significantly influenced by external factors such as weather conditions. The customer is responsible for ensuring that he or she is physically fit for the demands of the event.

(5) Should an event not be possible for reasons beyond the organizer's control (power outage, traffic accident, strike, natural disaster, etc.), the organizer reserves the right to withdraw from the contract before or during the event. In the latter case, the customer will pay the pro rata event price.

(6) The organizer is not liable for services that are arranged as third-party services provided by other service providers and are expressly marked as such. The organizer is also not liable for theft.

§ 10 Invalidity of individual provisions

The invalidity of individual provisions of the contract does not result in the invalidity of the entire contract.

§ 11 Place of performance and jurisdiction
